Noblesville Indiana Divorce LawyerQuestion:

My spouse withdrew a large amount of money after filing for a divorce from a joint account to purchase a home to flip without my consent or knowledge.

Is the money made when the property was sold considered marital property subject to division or does my spouse get to keep the profit from this investment?

Noblesville Indiana Divorce LawyerQuestion:

My wife and I are going through a separation primarily because of our fights over finances since I pay most of the bills even though her name and associated responsibility is on the majority of these items, including the marital home mortgage.

Our mortgage is underwater and my budget is even tighter now that she recently just walked out and moved out of the home leaving my children and I behind.

What am I to do in regards to this situation while struggling to pay the bills and mortgage?

Philadelphia Pennsylvania Divorce LawyerQuestion:

My wife and I separated, though it is not a legal separation and we have not filed for divorce yet because of lack of funds.

We have agreed that I will assume sole legal custody and sole physical custody of our child and she will have visitation rights.

Is it possible to reach an enforceable child custody agreement before a divorce is filed?

Question:

I'm looking for legal separation advice. While my wife and I were separated but still married, I paid off two loans using money I cashed in from my 401k. I was told I would be the one solely responsible for the taxes on the 401k withdrawl.

At what point in a separation leading to a divorce are assets and debt still considered marital property? Should we both be responsible for the tax money owed?

divorce attorney Jill DuffyQuestion:

My wife and I are in the middle of a divorce. We unfortunately had sex during an emotional breakdown while we were separated.

Will this affect the divorce case in any way? Do we have to start the whole divorce process over since there is supposed to be a set amount of time we are to be "separated" before the divorce can be granted?
