men's divorce lawyer Rachel BrucksQuestion:

A divorce judgment was entered against me though I never signed any papers nor have I seen a divorce decree, but I was served with divorce papers. She was awarded everything, including custody of our children. I want to know if our divorce is legal just because I was served?

Also, she has since remarried to a fellow drug addict and the living environment is no place to raise children. What rights do I have to get custody of my children?

men's divorce lawyer Rachel BrucksQuestion:

I have joint custody of my son. My child's mother always causes my son to miss swimming lessons, scout meetings, basketball practices, etc., during her parenting time.

My son wants to participate in these extracurricular activities. Is this a form of negligence on her part?

men's divorce lawyer Rachel BrucksQuestion:

I was recently notified that I overpaid my child support obligation by $10,000 due to my employer's payroll office reacting slowly to changes in my wage garnishment.

However, I was never notified by my state when this overpayment began and they let it go on for a significant amount of time. There is no accountability and the only suggestion they have given me to be reimbursed for this overpayment of child support is to sue my ex.

Are there any other options available?

men's divorce lawyer Rachel BrucksQuestion:

Can I stop paying child support since my daughter is married with a child even though she is younger than 18? Is she considered emancipated if she is married?

My ex-wife and I both gave permission for the marriage, which was needed since she is a minor, so the marriage is legal.

men's divorce lawyer Rachel BrucksQuestion:

I am a single dad that lives in Colorado with joint custody of my son. I am considering enlisting in the military to help get my life back on track and eventually provide my child with a better life.

If I entered the military, would I lose custodial rights to my child? Could I put language in the divorce decree that explains I am doing this solely for the long-term well-being of my son?
