I'm looking for financial advice on divorce on how to divide the benefits of my wife's retirement plan.

My wife receives larges bonuses at the end of the year. She says that if she has to roll half of her retirement over into a retirement account for me, upon divorce, her bonuses will be reduced drastically because they are based on the amount of stocks she owns in the company.

So can we leave all the money in her account with some contract that states I will receive half upon her retirement?

My financial advice on divorce question has to deal with delays in withdrawing 401k money post divorce.

My ex-wife was awarded the right to claim 50% of my 401k. The value of my 401k account at the time of my divorce six years ago was $100,000.

The current value of my 401k is $40,000, and my ex-wife now wants to claim her right to 50% of the account, but says it should be 50% of the value at the time of the divorce, not its current value?

How much is she entitled to since she took so long to proceed with this claim? She was also supposed to pay half of the QDRO preparation, but she never initiated the process.

She intends to keep the marital home. In exchange, she wants to trade home equity for my 401k on a dollar-for-dollar basis.

Since one is post-tax and the other is pre-tax, is there a formula for calculating or comparing the values?

My late husband's ex-wife was awarded a QDRO (Qualified Domestic Relations Order) of a set amount of his retirement account. I am to receive the balance of that account as the named beneficiary.

However, she plans to submit the QDRO when the account is at an economically depressed level so she will collect her share and there will be nothing left for me.

Can I force them to submit the QDRO so I can receive the balance of that account?

I have since remarried after my divorce was finalized.

What claim does my ex-wife have on my QDRO (Qualified Domestic Relations Order) since we still have yet to complete the paperwork concerning my retirement fund?

I live in Virginia and we divorced in California so which state has jurisdiction?
