child custody modificationQuestion:

I am worried about my children's living conditions when they are with my ex-wife, and I would like to know if a child custody modification is justified.

I keep a very clean home and provide a stable environment for my children, which they do not receive when staying with my ex-wife.

How can I get my kids' living conditions inspected and have it officially recorded to present as evidence during a possible child custody modification trial?

fault divorceBy Sara Pitcher

There are several defenses that are available to defend against accusations of wrongdoing and fault in a fault-based divorce.

Even though most states are moving away from fault-based divorce, you will still want to be prepared in the event your wife files for divorce alleging fault.

As mentioned in my previous divorce article "No-Fault Divorce vs. Fault Divorce," some acts that constitute grounds for fault-based divorce include adultery, physical or mental abuse, conviction of a felony, or abandonment.

So if your wife alleges fault, here are 5 defenses you may be able to use.

marital property divisionBy Sara Pitcher

Cordell & Cordell Indiana Divorce Lawyer

The majority of states divide property via equitable distribution with many of those states presuming that marital property division should be equal.

This presumption may be rebutted with the presentation of evidence by either party that an equal division would not be just and reasonable.

dividing property divorceQuestion:

I am going through a divorce and want to know the repercussions of starting a small business before my divorce is finalized.

Because of divorce waiting periods, my divorce won't be final for almost a year and I would like to start my business as soon as possible.

How are assets and/or debts accumulated during the separation period but before the divorce is finalized handled? Can my estranged wife claim half of my business if it is launched before we are officially divorced?

what is discoveryBy Nathan A. Hacker

The biggest advantages to taking a deposition is that you can be sure what your wife is going to say at trial, and you can hope that it changes.

Strategically it does not matter what story is told, but that a story is told.

In depositions, you are trying to find out what the testimony will be at trial so that you and your divorce attorney can formulate a strategy that will maximize your results, or minimize your exposure, whichever the case may be.

Anything that your wife says in her deposition can be brought in to trial through the impeachment process.

Let’s take a look at an example of a deposition:
