The biggest advantages to taking a deposition is that you can be sure what your wife is going to say at trial, and you can hope that it changes. 

Strategically it does not matter what story is told, but that a story is told.

In depositions, you are trying to find out what the testimony will be at trial so that you and your divorce attorney can formulate a strategy that will maximize your results, or minimize your exposure, whichever the case may be. 

Anything that your wife says in her deposition can be brought in to trial through the impeachment process.

After your divorce decree has been finalized and entered by the court, you should seek counsel regarding any trusts or estates that you have set up for your family.

You will want to have those rewritten so that your children are the beneficiaries of your hard work. 

If you have a life insurance policy that lists your ex-wife as the beneficiary you may want to consider having that transferred into a trust for your children.

So you just received the divorce decree from the court. Now what do you do? The obvious answer is read it.

After you have read the decree, ask yourself the following questions:

  • Did the judge get it right?
  • What remedies do I have?
  • Are they worth pursuing financially?
  • What does my Last Will and Testament say? 
  • What do my insurance policies say?
  • What else do I need to do under this order? 

While I don’t make it a practice to say that judges get things wrong, occasionally there is a different way of looking at the facts that would more closely resemble the intent of your state’s legislature when it comes to the division of assets or child custody.

Just because the judge put it on paper and signed it doesn’t mean that it was done as well as possible.
