rights for fathersThe Huffington Post, one of the world’s most visited websites, has turned to DadsDivorce.com founder Joseph Cordell to be its voice on the struggles men and fathers face in family law courts.

In his first of a series of columns, Cordell writes on HuffingtonPost.com about the unlevel playing field facing divorced dads in the family law system.

He explains how after 20 years of experience spent with Cordell & Cordell representing men in domestic relations matters, he couldn’t help but notice the challenges consistently facing one side of the table--the guy's side.

"The father's rights movement isn't an anti-mom or anti-woman movement; it's an anti-unfairness movement," Cordell writes. "It just so happens that moms have most of the power in the family court system in America."

divorce questions to askBy Matt Allen

Editor, DadsDivorce.com

Divorced dads will sometimes consider representing themselves pro se to keep costs down at a time when resources may already be stretched thin.

Inevitably, they have two divorce questions to ask:

  • Should I actually try representing myself?
  • We’re agreeing on everything so do I even need an attorney?

The discovery process is one of the most important parts of your family law litigation.  You may have sent Interrogatories and Requests To Produce Documents to your ex, and you may have to answer these same discovery requests.  But what if you don’t want to respond to them? Or what if she never responds to your requests?  Do the questions and requests just hang out there, unanswered? Or are there are consequences?

Sometimes, a story will appear that makes you think legislatures have no idea of the impact of certain laws being enacted. It is only when a statute is passed, and the rights of a state’s citizens restricted, that the full effect can be measured. It is hard to imagine just how anyone could have voted for a law where an unwed father only has fifteen days to “stake his claim” upon the birth of his child, or risk losing the child forever in an adoption proceeding.

The Violence Against Women Act (VAWA) will expire this September if it is not reauthorized by Congress. Largely viewed as an anti-domestic violence measure, VAWA has become a flashpoint for the men's rights advocates who see it instead as the living symbol of anti-male bias in law. Although a significant number of domestic violence victims are male, VAWA defines victims as female. As one result, tax-funded domestic violence shelters and services assist women and routinely turn away men, often including older male children. Estimates vary on the prevalence of male victims.
