Texas divorce lawyerQuestion:

Do child support laws consider children from previous marriages when calculating child support?

I already pay child support for one child I had with my ex-wife. Now my current wife and I are getting divorced and I'm worried about having enough money to pay child support for our children as well.

Are previous child support payments from a prior marriage considered when issuing new child support orders?

Texas divorce lawyerQuestion:

I was unable to attend the temporary hearing where my wife and her divorce lawyer misrepresented my financial information for alimony and child support.

As a result, my temporary orders for alimony and child support payments are 75% of my monthly net income.

Can I appeal this decision and modify the temporary orders?

Texas divorce lawyerQuestion:

Is there a paternity law that addresses potential paternity fraud?

I signed a Voluntary Acknowledgement of Paternity at the time of my child's birth. I now have reason to believe the child's mother lied to me about being the biological father.

I would like to get a paternity test done and possibly rescind the acknowledgement of paternity if it comes back that I am not the biological father.

What are the steps I need to do to get the paternity test done?

Texas divorce lawyerQuestion:

My wife wants to kick me out of the marital home, but still expects me to continue paying the mortgage.

She says if I try to default on our mortgage she will take me to court to enforce payments to ensure she can continue living there.

Can a court keep the paying party from purposely defaulting on the marital home mortgage?

Texas divorce lawyerQuestion:

My wife and I have no children and are headed for divorce. Will the divorce process be smoother because we don't have to deal with child custody and child support issues?

What are the differences between getting a divorce with children or without children?
