divorce lawyer Jason HopperAsk A Lawyer Question:

Regarding Indiana Child Support, Code § 31-16-8-1 regulation states that a modification can be made to child support upon showing (among other things) "(2)(A) a party has been ordered to pay an amount in child support that differs by more than twenty percent (20%) from the amount that would be ordered by applying the child support guidelines."

When computing this threshold, should one take 20% of the previously ordered amount or 20% of the newly computed amount based on the current circumstances. Believe it or not, in my case, it makes a difference.

Attorney Jason HopperQuestion:

I have been estranged from my children for over 10 years. Both children continue to repudiate me and are the victims of parental alienation. My ex-wife is seeking more support to help with their college expenses.

I have done exhaustive research on case law and from what I have read, my support and financial obligation to the children should stop immediately because they have repudiated me. Do I have a case?

Attorney Jason HopperQuestion:

My soon-to-be-ex wants the kids to continue going to daycare even though I am willing and able to watch after them.

Since we are still married and there is no custody order in place, is it OK for me to make the decision to refuse to take them there and pay for daycare? Shouldn't I have right of first refusal?

If she does take them to child care without my permission can I call the police for kidnapping or something else?

Attorney Jason HopperQuestion:

I currently have child support obligations, which includes paying off child support arrears, in four states due to multiple marriages. With each state taking its share of my paycheck, I would have less than $50 every two weeks to survive on. I'm committed to paying what I owe, but with four states coming at me at once it is impossible.

What steps are necessary to straighten out my child support obligations which have had courts from four states taking action to either potentially or actually set up support obligations?

Attorney Jason HopperQuestion:

My ex-wife is the guardian of my children. She has had my child coached on parental alienation and now has my child claiming I sexually abused her, which is absolutely false.

Since the allegations, all visitation and contact has stopped while I continue to pay child support. What is my legal recourse due to my parenting time being cut off because of  unsubstantiated allegations of sexual abuse?
