Many divorced dads are victims of their ex-wives violating parenting time provisions in child custody agreements. While many divorce articles on DadsDivorce.com discuss enforcing parenting time, what about if you are the one who misses a scheduled visitation?

If it is deemed you are violating the parenting plan, what is a typical penalty? A fine? A loss of visitation rights?

Question:

During my wife's parenting time she frequently does not spend the night at the marital home, instead sleeping at her boyfriend's house.

She says the kids are old enough (ages 12 and 17) to spend the night alone, but I'm concerned for their safety and would rather have them with me than leaving them alone.

Would the courts be likely to modify our visitation schedule or allow me to have the kids when she doesn't want to stay at home during her parenting time?

My ex-wife was awarded primary child custody and exclusive rights in regards to deciding where our children live. She has repeatedly moved from the state we were divorced in, but is currently living in a state that I recently moved to.

I am trying to get back into my children's lives, but I am fearful that she will move again.

Are there any chances the court will amend the orders and not allow her exclusive rights to decide where the children live since she constantly moves in part to keep me away from my children? What jurisdiction would I need to file this motion in?

In my divorce settlement, I was awarded exclusive use of the marital home.

My ex-wife still has keys to the house and still has personal property in the house.

What rights do I have under exclusive occupancy? May I change the locks? May I demand she move her property out by a certain date and dispose of it if she fails to comply?

When and under what circumstances can she enter the property?

Question:

When modifying child support, what documents do child support laws allow to be used as proof of assets?

My ex-wife is asking for an increase in the child support I pay her. In asking for my income, her attorney requested I provide my car titles and my bank statements.

I don't understand why they would need these things, especially since she won't be able to get my car, in order to figure out a new child support order.
