Omaha Nebraska Divorce LawyerQuestion:

In my divorce, my ex-wife and I were to split all debts 50-50. However, she has failed to pay many of the utility bills and now those companies are coming after me for full payment because she is not working.

Can I just show them the divorce court order that I am only responsible for half the debt and that they need to go through my ex-wife for the other half? Or will these companies hold me fully responsible for these debts?

Omaha Nebraska Divorce LawyerQuestion:

My question is about how much alimony and child support I am going to have to pay and if those calculations are based on my current overloaded work schedule.

I work two jobs and nearly 80 hours a week to support my family because my wife refuses to work. I have been doing this for years.

Will my alimony and child support payments be based on these outrageous work hours or will a judge calculate payments based on a reasonable work week that hopefully I can return to post-divorce?

Omaha Nebraska Divorce LawyerQuestion:

My ex-husband and I filed a joint tax return in 2010 while still married and we owed a lot of money. We divorced in 2011.

How would we handle the 2010 tax expense debt if it was not addressed in the divorce decree? My ex-husband says I owe him half the debt but I cannot afford it.

Omaha Nebraska Divorce LawyerQuestion:

When I was employed and paying into FICA out of each paycheck, I also paid a child support arrears garnishment from the same gross earnings.

I am now disabled and receive RSDI benefits that come from my FICA account. The state is now garnishing my RSDI benefits even though the money that is in my FICA account has already been garnished under the exact same case number.

Wouldn't that be considered duplicative wage garnishment?

Omaha Nebraska Divorce LawyerQuestion:

My ex-wife has repeatedly violated our divorce decree by claiming our son when filing taxes, even though we have 50-50 joint custody and the court order allows me to claim our son every year.

This has happened for four years now where she has beat me to the punch and filed first claiming our child.

What can I do so the IRS knows she is in violation of the order and I should be the one allowed to claim our son? Can I be reimbursed for the money this has cost me over the past four years?
