Paternity Law Question:divorce lawyer Erin Clark

How does paternity law address situations where a wife gives birth to another man's child while still married to her husband?

I have been separated from my wife for three years, but we are not legally divorced yet. She is pregnant with another man's child and will give birth while we are still legally married.

Is the child considered mine since we are still married even though it's impossible that I'm the biological father?

Alimony Question:divorce lawyer Erin Clark

My soon-to-be-ex is terminally ill and was ill at the time she filed for divorce. Because of her condition, I have been ordered to pay alimony and all of her bills, including some medical costs, which have a current outstanding balance of almost $50,000.

Now the judge has ordered me to take out half of my retirement to help cover costs.

Is there anything that can be done to challenge the judge's decisions? I am going broke and now going through my retirement funds!

Question:divorce lawyer Erin Clark

I would like to get child custody of a child I believe is mine. The child's mother doesn't want me to do a paternity test for whatever reason.

Is there a paternity law that allows for me to force her to take genetic testing to prove who is the child's father?

Question:divorce lawyer Erin Clark

My question is about child support laws when paying your ex directly.

I have paid every penny of child support I owed, but I received a notice that I owed $10,000 in child support arrears. This is likely because sometimes I would pay my ex-wife directly so the payments didn't go through the child support office.

If my ex isn't willing to admit she received the payments, is there anything that can be done?

Question:divorce lawyer Erin Clark

Our child custody agreements are outdated and I would like to file a modification to address our parenting time.

I would like to keep my scheduled visitation with my daughters on Thursday nights, but I need to file a modification allowing me to take them to ballet practice on Wednesdays.

How can I get this modification to take effect? Can my ex-wife and I just reach an agreement and change the order on our own. If I have to file a modification with the court, is this something I can handle on my own or is it more complicated that would required a divorce lawyer's assistance?
