Question:divorce lawyer Carrie Westbrook

I need financial advice on divorce on what my rights are to the marital home if I move out of the property.

If I leave the home and move to another state, do I have any future rights or claims to the marital home in the event we do divorce?

How can I protect myself from my wife hiding assets or running up debt if I am not living in the marital home with her?

We live in a "Charlie Sheen World" where movie stars and musicians are celebrated for their bad behavior and poor choices. 

With all of these outside influences, parents find that it is more important than ever to impart morals and values on their child even when the child is in the care of an ex-spouse.

This has led to an increase in "Morality Clauses" being included, by consent of the parties, in Marital Separation Agreements.

If the case proceeds to trial and the judge makes a decision, it is rare to see a judge include a Morality Clause in the final order. However, it may be done under some circumstances as discussed below.

Charlie Sheen custodyHis erratic and outlandish behavior has garnered Charlie Sheen a massive amount of attention the past week, but it also at least temporarily cost him custody of his children.

Police removed Sheen’s twin boys from his home per a court order issued after his estranged wife said she feared for her life, according to CBS News. Brooke Mueller filed legal papers saying Sheen threatened her with physical violence and stated, "I am in great fear for the children's safety while in his care."

CBS News reports the temporary restraining order prevents Sheen from getting within 100-yards of his twin children for roughly three weeks. (Note: image taken from Sheen's Twitter page.)

Though not as publicized, fathers find themselves frequently defending themselves from accusations of violence as emergency orders are more often used now for strategic reasons in divorce cases.
