Question:

My wife is from Bahamas and we have a 8 year old son and she has threatned to take son away to the Bahamas. How does that work with custody of my son and the posssiblity of him moving to the Bahamas? My wife has has mental issues and was prescribe with medication for emotional issues. Can that factor in to custody and can that be used.

Answer:

Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of Georgia. Yes her mental condition is relevant in custody. Generally she can not take your son out of the country without your consent. Once your case is filed (for divorce), then the court will not allow her to move him out of the country during the case. She will have to prove it is in his best interest.
