Texas divorce lawyerQuestion:

My wife is having an affair and I want to know if it's worth the effort to address in divorce court.

I do not have any "professional" documentation or evidence of her affair other than her admissions to me and the fact she has moved out and is believed to be living with another man.

What advantages are there in proving her infidelity and affairs in a divorce case? Is it worth pursuing?

Texas divorce lawyerQuestion:

My divorce question is about claiming children for taxes when owing child support arrears.

Per my divorce decree, I am to claim our youngest daughter every year for taxes. Last year, she claimed our daughter stating she had the right to do so because I was in arrears with my child support, and she said she is planning on doing the same this year.

I warned her that what she is doing is in violation of our decree and probably tax fraud. Can she really do this if I owe back child support?

Texas divorce lawyerQuestion:

I would like to appeal a child support ruling.

My ex-wife receive an uncontested divorce from me several years ago because I was never notified of the trial and thus never received an opportunity to speak to the judge.

As part of the divorce, I was ordered to pay child support. Can I appeal this child support order since I do not think it was fair to enter a judgment against me when I wasn't there?

Texas divorce lawyerQuestion:

I pay child support and child care expenses and they are clearly separated in the divorce decree. Several years ago, my ex starting working from home and cancelled child care so I stopped paying for those services.

Now I receive a letter from child support services saying I owe tens of thousands of dollars in child support arrears because I was not paying the full amount.

How do I defend myself from being responsible for years of child care expenses that I did not pay because the kids were no longer in child care?

Texas divorce lawyerQuestion:

I would like to know if my marriage can be annulled.

My current wife recently received a notice that her divorce paperwork from several years ago was never properly finalized and her marriage to her previous husband is still valid.

So is our marriage valid or is it void? If we were to break up, would I just be allowed to move on or would I have to go through divorce proceedings?
