Omaha Nebraska Divorce LawyerQuestion:

My wife is pregnant by another man. I am thinking about filing for divorce because I feel like it is my only option.

But is there anything other than divorce I can do to protect myself?

I don't want to be responsible for another man's child if we do end up separating for good.

Answer:

I am unable to give you legal advice on divorce. I can give general divorce help for men, though, my knowledge is based on Nebraska and Iowa paternity laws where I am licensed to practice.

Once you sign a birth certificate or acknowledgement of paternity, or if the child is born during the marriage, or even if the parties later marry, the husband is presumed to be the father. 

With that presumption, the opposing party must prove you are not, and that it is in the best interests of the child that the relationship with you be severed.

So now the question comes down to what can you do.

Some jurisdictions allow for the biological father and the husband to sign an acknowledgement that although the woman was married, the biological father accepts responsibility for the child. This could be available in your jurisdiction. 

Making sure that you are not financially responsible, especially if you are already contemplating the possibility of severing the relationship, requires prompt attention.
