Legal Separation Agreement Modification

Noblesville Indiana Divorce LawyerQuestion:

When a legal separation agreement is signed by both parties can the terms be modified?

Does the legal separation agreement dissolve when the divorce is final?

Answer:

I am unable to give you legal advice on divorce. I can give general divorce help for men, though, my knowledge is based on Indiana divorce laws where I am licensed to practice.

If the parties reach a provisional agreement to govern during the pendency of the divorce and it is approved by the court, then it will remain in effect until modified by agreement of the parties or further order of the court.

If the parties are not agreeable to a modification, then one party may file a request with the court to modify the provisional agreement by showing a substantial and continuing change. The court will then hear evidence and determine whether there should be a modification.

If the parties agree to a modification, it should be done in writing and submitted to the court for approval to become an order. This provisional agreement/order will then be superseded by the final divorce agreement or order.
