How Can A Marriage Be Annulled?

I would like to know if my marriage can be annulled.

My current wife recently received a notice that her divorce paperwork from several years ago was never properly finalized and her marriage to her previous husband is still valid.

So is our marriage valid or is it void? If we were to break up, would I just be allowed to move on or would I have to go through divorce proceedings?

Answer:

The marriage would be considered void and could be annulled since it was entered into while she was still married to someone else.

However, if you choose to stay together then a marriage would become valid once the prior marriage is dissolved as long as you continue to live together as husband and wife.

If you want to follow through with dissolving your marriage on the grounds of existing during a prior marriage, then you would file for an annulment.
