Ex Hires New Divorce Lawyer Without Notifying Me

Question:Colorado Divorce Attorney

I was recently back in court for a divorce decree modification and my ex-wife had a new divorce lawyer, but I never received notice of this from the court.

After checking with the court clerk, I was told that her attorney never filed an appearance on behalf of my ex-wife.

Is this legal?

Answer:

I am only licensed to practice in Colorado so I cannot provide you with legal advice on divorce, but I can provide you with some general divorce help for men regarding your divorce laws question.

The appearance of a new divorce lawyer in your divorce case is legal. The attorney may not have filed an Entry of Appearance yet or the attorney may have chosen not to.

The physical appearance of the attorney in court as well as the filing of any documents with the court can also be considered an entry of appearance.

The failure to file an Entry of Appearance ahead of time will not matter for the purposes of the court.
