Divorce & Safety of Children: Rifle Close to Kids in Ex’s House

Question:elisabeth flemming attorney nevada

Recently, I found a picture posted on my ex-wife’s Facebook page of our daughters sleeping on a couch with a rifle sitting in the room and close to them.

What are my rights to do something about this potentially dangerous situation?

Answer:

While I am not licensed to practice law in your state, I can give some general guidance on this issue.

I would first recommend that you reach out to your ex-wife to discus the issue. Express you concern regarding a firearm being left unlocked and left out in the open around you children.

If she does not respond or does not remedy the situation to your satisfaction, you may want to bring this issue before the court. You can request that the court make an order regarding firearms in the home and require that your wife take the appropriate steps to keep the firearms locked away.

If this continues to occur, or if she fails to comply with the court’s order, this may eventually be a basis for a request for you to modify your custodial arrangement based upon the safety and welfare of your children.

Remember, I am unable to provide you with anything more than divorce tips for men, so please consult a domestic litigation attorney in your area to obtain specific advice as to the laws in your state and how they impact your potential case.

What if the situation is the child complains to you about a boyfriend or new spouse that something happened, but wouldn’t go into details. You raise the issue up with the ex and they defend the new boyfriend or spouse. What course of action would you suggest be taken.
