I will be deployed overseas when my oldest child reaches the age of emancipation that should result in a child support modification.

How can I have my child support lowered when I am out of the country unable to attend any modification hearings?

Answer:

I am unable to give you legal advice on divorce. I can give general divorce help for men, though, my knowledge is based on Pennsylvania divorce laws where I am licensed to practice.

You could hire an attorney to represent you that could petition for modification of the child support order on the appropriate date and secure permission for you to attend the hearing via telephone. 

If you are planning to handle this matter yourself, you can contact the Domestic Relations Section that handles your support matter and ask that they provide you the paperwork necessary to request a support modification.

If possible for you, you could submit the petition and all of the required financial information by mail and also request permission to participate at the modification hearing by telephone.

Under the Servicemembers Civil Relief Act, you can also give a family member or friend power of attorney and they can act as a factual witness at a support proceeding. Although, please note that they cannot represent your interests in the way a family law attorney can.

Please note that if your salary changes while you are deployed, then this could also impact your child support obligation because a significant increase in pay could mean an increase in your monthly obligation.
