Texas divorce lawyerQuestion:

Do child support calculators consider the reason for a person's unemployment when setting the final amount?

My soon-to-be-ex-wife just got herself fired for gross misconduct. Since she now has zero income it is likely my child support payments will be higher.

Will the child support calculation take into account that it was her actions that caused her to lose her job?

Answer:

I am unable to give you legal advice on divorce. I can give general divorce help for men, though, my knowledge is based on Texas child support laws where I am licensed to practice.

Child support can be calculated based on the earning potential of the party or even an average of the past several years of wages reported on the tax returns of the parties, especially in a situation such as this.

At the very least, child support is based on minimum wage, what the court assumes every individual could earn, and not a current earning of zero dollars because she was fired.

If the court does decide to base child support on minimum wage or a very low figure because of her situation then I would ask for a review as soon as she is employed elsewhere.
