Depending on the type of retirement plan that a party has, a Qualified Domestic Relations Order may be necessary to divide the interests in the account (QDRO).

A QDRO is a legal document created to direct the retirement plan administrator to divide the benefits as set out in the divorce decree.

The portion that your ex-wife is entitled to may very well depend upon the laws of your state as well as the terms of division outlined in your final divorce decree.
