Admissibility of evidence in a divorce case

Mens divorce lawyerQuestion:

I have read and made copies of my wife’s journal entries, which prove she deliberately tries to provoke me in an attempt to show me as an unfit parent.

Can I submit the copies I made to the court to serve as proof that she did this?

Answer:

There are many complex laws regarding the admission of documents into evidence at trial that vary state by state.

The facts you described indicate that your spouse hand wrote a journal, which shows her plot to portray you as an unfit parent. At the time of trial your spouse will likely speak negatively about you. Typically, once a person begins to lie, you can use a document to impeach that testimony.

Please note that the application of evidence laws is a skill that takes some lawyers years to develop. For that reason, I recommend that you consult an experienced attorney to handle your case.

I am happy to have assisted you with your question. However, please understand that my opinions are based upon the limited facts that you provided to me. For a more in depth discussion of your legal rights, I urge you to contact an family law attorney immediately.
