Question:
I have paid a layer in full by April 2007 all of his fees that he has requested. He has not responded to my case in any way. I contacted his office last week (May 2007) and his secretary said she did not have any records showing my case had been paid in full. I faxed her two checks from my bank showing the payments. She told me she would send some papers for me to sign and she did. I signed the papers and returned them, after a week went by I called her and she said she was sending the papers to my ex. Well, I caller her again today and she tells me that she has not sent the papers out because she was swamped with other work. What can I do about this issue? If they have too much work why did they take my case to begin with? If I am being scammed, who do I contact?
Answer:
Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of South Carolina. Generally, your lawyer needs to be responsive to you within a short amount of time. You should always know what the status of your case is. I always advise clients to be sure to choose someone who they trust and feel comfortable communicating with openly. This is a very difficult time in your life so you should be sure to choose wisely. If you are concerned you are being scammed then you can contact your state bar to be sure that your attorney is in good standing with the bar.
