Question:
It has been two long years and finally the trial is set, but just recently they want to request a continuance. Not sure of the reason, but what are the specifics? Do they have a chance?
Answer:
Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of Tennessee. Generally continuances are granted for good cause meaning a party needs time to further prepare, has a conflict or some other reason that going forth on the day of trial will be prejudical to a client if a continuance is not granted. The continuance is generally very discretionary for the judge. You have the right to object to the continuance. You must state to the court the reason why this continuance is prejudical to your case.
