Question:

My childrens mother may have Attention Deficit Disorder (ADD) and may be affecting the childrens ability to excel in school. She currently has full physical, joint legal. I want to have full physical and full legal because I can be sure they get the homework done and progress academically. What are my chances of winning the case?

Answer:

Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of Hawaii. First off is she diagnosed? What proof do you have of her lack of follow through with the homework? How are they doing in school? If they are not excelling, have you spoken to the teachers? Have you been dealing with them on a plan for the kids to do better? Make sure to make a presence at the school. See if the teachers can determine if the homework is done when with you, but not her. These kind of third party objective witnesses are the key to winning cases like these.
