Ask A Divorce Lawyer: Are funds from the GI Bill taken for child support?

Question:

I am a military dad paying child support and about to go back to school thanks to funds made available by the GI bill from the federal government. Will child support come out of those funds? As part of the GI bill, I will also receive a basic allowance for housing. Can they take child support from that housing allowance?

 


Answer:

I must preface my answer that I do not practice in Texas.  However, Cordell & Cordell has many attorneys licensed and located in Texas who would be happy to help you.  Each state has different laws governing child support. It is important that you contact a domestic litigation attorney licensed in Texas prior to taking any action.
 
You should consult the child support guidelines in place for Texas.  Each state has guidelines that are unique to it.  However, in most jurisdictions any income provided for housing will be considered income that will be included in calculating your child support.  As for money provided to you for educational purposes, in most jurisdictions this money will not be counted as income against you when calculating your child support.  As stated earlier, it is important that you consult the child support guidelines in Texas to verify how housing and educational funds are defined.
