Ask A Lawyer: Can She Really Take 1/2 My Income And My Child?

Friday, 13 November 2009 00:00

Question:

Is it true that my wife can take my child, half of my income, and never let me see him?  I’m wondering what the truth is because this is what she is threatening me with.

Answer:

Generally speaking, the answer is, “No”. Talk with an attorney licensed in your jurisdiction regarding your options and her options, but generally both parents will get time with the children child.  Also, child support is usually based on a percentage or share of one or both parents’ incomes.  Further, it is the Court which controls these issues, not the parents.

Erik H. Carter is a Senior Attorney of the Cordell & Cordell, P.C. office in Indianapolis, Indiana as well as the Litigation Manager of both the Indianapolis and Pittsburgh offices.
